Planning commission recommends that city should reject chicken permit for Rome family

A Hycliff Road family will have to get rid of their pet chickens if the Rome City Commission follows the recommendation of a citizen board.

The Rome-Floyd County Planning Commission voted 5-3 Thursday to reject Christopher Lewis’ request for a special use permit to keep hens in his back yard for eggs and as a learning tool for his home-schooled children.

The issue of regulating poultry inside the city limits, however, will be on the planning commission’s January agenda for further discussion.

“The opposition could be local (to the Lewises) and the support citywide,” member Nathan Roberts said.

This is the second time the planning commission recommended denial of the Lewis case, but it’s become somewhat of a symbol for the growing urban poultry movement. Supporters and opponents have both weighed in with letters, calls and testimony.

It’s also the second time City Commissioners have decided against loosening restrictions on raising chickens in Rome. But recognizing that it’s happening anyway, they sent Lewis’ application back to the planning commission with instructions to see if adding conditions could make it more palatable.

Roberts argued that Lewis has since erected screen fencing on both sides of his yard and ensured the coops are kept at least 30 feet from his lot lines.

“He’s trying to be a good neighbor,” Roberts said.

But Frank Brown noted that the hens were established without the required special use permit, which was sought only after a complaint was filed.

“This came here because of the neighbors,” he said.

Roberts and members Charles Jackson and Christian Terry voted in favor of the permit. Brown and members Elaina Beeman, Joel Holcomb, Terry Jones and Ronnie Kilgo were against it.

City commissioners allowed Lewis to keep his hens until his application is decided — a public hearing is scheduled for the board’s Dec. 17 meeting — but placed a moratorium on new applications until the issue is settled.

During an informal discussion last month the elected board indicated it would not support an automatic permitting process.

The appointed planning commission is expected to consider beefing up regulations governing special use permits and further limiting the zoning districts or lot sizes where poultry could be allowed.

Come on people. We are talking about chickens running around. These people sound like they are doing all they can to contain the chickens. The problem is that other people may not o the same thing. Where will chickens lead to? Will the Commission be forced to review requests for goats? Hispanics keep goats for the same reason people keep chickens. A goat can provide milk, cheese, and meat.

This is a neighborhood. If this young purple intended on having chickens, maybe they should have looked into buying a house in the county. I commend them for the way they have peacefully looked for a resolution and the way the followed the proper channels.

What I do not commend is people coming on here attacking the people who don't want the chickens in their neighborhood. This is an issue between neighbors. These people have chosen to go the the City Government to resolve their dispute. The City Government is elected by us. If you do not like the city government's decision, make our vote heard at the ballot box. But, I will say there are more pressing matters facing our city than chickens.

Mr. Brown.. the neighbor's daughter already said that if issues were resolved (which they were) they had no problem, it is YOU that has the problem. A few chickens are much less of an issue than a couple of dogs. They aren't running a farm, just a few well kept hens. This entire issue is ridiculous and a waste of time. Issue the permit with reasonable guidelines and move on. Meanwhile the Lewis family is tangled in the web in limbo, running to meetings and expense without resolution.

Please consider attending the December 17th City Commission meeting at 6:30 in the city auditorium to voice your support for the city coming up with guidelines for responsible hen ownership. We are unsure why our special use was heard again at the planning commission meeting rather than them discussing rules for keeping hens within the city limits, but we hope that the City Commission will again defer on our request while they iron out some definitive guidelines so that both hen owners and their neighbors can live in harmony and respect each other by following rules regarding the keeping of hens.

If the Commission bans the Lewis' from having chickens that will provide FOOD for their family, then the "offended" neighbors and Commission members should have to supply them with the eggs they are refusing them.

I will second that "nuisance neighor" problems are much worse than a few chickens: For example,

-Four-wheelers are not street-legal vehicles and do not belong on city highways.

- Not everyone wants to hear your window-thumping, foul-mouthed rap and heavy metal music.

-My yard is not YOUR dog's toilet bowl. Keep the poop in your own yard!

I'd take a few chickens any day.

This is actually a story of a larger problem. People are so self centered and afraid to deal with life issues that they automatically turn to government to solve all their problems and provide all their needs.

When I have a problem with my neighbor I go to him and work it out. Unfortunately 99% of the public will call the authorities before they will ever face their neighbor and risk confrontation.

For God's sake if these people are responsible let them keep a few chickens.

Side note: The Lewis Family has their name all over the internet and paper yet their cowardly neighbors do not have to undergo the same scrutinization.[spell check error}

Thank you Rome Planning Commission! I hope the city commission follows your vote. I am against my city neighbors having chickens. If you want to keep such farm animals, please move to the county. Some of us who choose to live inside the city limits so we don't have to smell or hear chickens daily don't want them as neighbors!

And proud2be, lets ban dogs too. I am tired of being woken up at 2 AM by the neighbors THREE barking large dogs they do nothing about. We had a neighbor with a goat for a while, never heard a noise from that goat. And another neighbor has a rooster. Yes, we hear it frequently in the morning, but we never smell it. But as for their hen chickens, we do not hear them at all (nor smell them). Can't say the same about the dog poop we clean up in our front yard from other neighbors' roaming dogs. Disgusting.

Ya know? We caucasions have lost the art of assembly and protest. This sounds like the perfect opportunity get back in the game and form Occupy Coop and help these people out. Leave these people alone. Neighbors of the Lewis's, get over it. Dogs and cats are way more of a nuisance than chickens (barking, pooping, walking over and scratching up cars, etc.) and I'm a dog owner myself. It's not like we're talking full-blown chicken houses here. Heck, it seems like almost everyone in W. Rome has chickens now. I don't see a big stink (from the commission or the chickens) about it over here. What a pathetic "town" this place is. Roads are crumbling. Ehhh, there's dirt under them. Intersections don't line up. Ehhh, they'll figure it out one day or crash. People have chickens on their private property. WHAT?!?!?! OMG!!! WE CAN'T HAVE THAT. SEND IN THE NATIONAL GUARD!!!!

Fiscal cliff, healthcare worries, high school dropout rates, environmental disputes, wars abroad, football ... so much else to worry about.

I don't understand why we keep having these controversies over chickens in the city. I can understand objections to big commercial operations but where's the harm in a family having a few chickens for personal use?

I can think of dogs (and even a few cats) that have been bigger nuisances than these chickens probably are.

If I'm missing something, let me know.

There are twelve months in a year and twelve eggs in a dozen. How many extra eggs past a dozen would you have if you had 19 eggs? Apply the same answer in regards to months beyond 1 year of age and you find the typo in the picture's caption. I bet the Lewis children can figure that out quicker than the proof reader did.

Leave the freaking chickens alone!

Mr. Lewis,

I would advise you to MOVE out of the city. Hopefully, whoever purchases your house will be loud and trashy. (Nothing is ever done about those people.) Which would be only fitting for your Hycliff neighbors who wish to have your freedoms taken from you. There are massive amounts of property for sale right now in the county. Trust me, today, it's the chickens. Tomorrow, who knows what they'll want to take away ? MOVE !

I agree that nothing is done about the loud and trashy ones. I live about 6 houses from the Lewis family and the only people in this neighborhood I have a problem with are the ones who like to ride their non-street-legal dirt bikes up and down my street with shotguns strapped to their backs. This is only one family, and our neighborhood is more concerned with chickens than these dangerous fools.

I think the Lewis family is exercising their right to liberty and their PROPERTY RIGHTS.

If the City government wishes to continue this battle, I will be happy to oblige.
